Recalling The Millenium Shows - Santa Maria Times, Karen White A $21.2 million dollar civil trial, pitting superstar singer Michael Jackson against a German promoter, is grinding away slowly in a Santa Maria Superior Court. It could last well into December, with a week-long break for Thanksgiving, for the jury of eight women and four men. The civil action involves the alleged failure of Jackson, who lives near Los Olivos, to performing two contracted and planned millennium concerts for promoter Marcel Avram, in Sydney, Australia, and Honolulu, Hawaii. Jackson said Avram canceled the shows, for which he was to receive $15 million. Santa Maria Superior Court Judge Zel Canter is presiding. Avram testified briefly Wednesday, followed by Jackson. The entertainer had been scheduled to appear at 9 a.m. Thursday, but did not appear until 1 p.m. He is due to return again at 9 a.m. today, with testimony only until noon because a female juror will be given time to attend a Friday afternoon family funeral. Asked if Jackson would arrive on time today, the artist's attorney, Steve Cochran, said "I hope so ... I'm not sure." But Jackson will not be available next week, because he must travel to Germany to receive a major humanitarian award. Canter questioned Jackson about giving up the trip to Germany or appearing electronically. "It is a significant honor for people working with children. I want to encourage more celebrities to do more for children around the world," Jackson said.

The judge dropped the issue, determining that Jackson could return later if the plaintiff's questioning of the artist is not finished. Louis "Skip" Miller, representing promoter Avram, promised to move the case along this morning. The challenge for Miller is Jackson's inability to remember details about arrangements for concerts, the people who work for him, documents he signed, letters he allegedly had sent and even statements he made earlier in a June deposition. "I think I heard talk about the Sydney show," he said, but he could not say, "for sure" that he knew about two millennium shows. He testified he did not know about a dispute between "his people" and Avram between a $15 million gross payment against $7 million flat rate, with no expenses deducted. Sometimes confused about written documents and memory questions, Jackson read slowly and took even longer Thursday to phrase his answers. At one point Thursday he "had nothing to say" in answer to a question. And Jackson also could not remember an August 1999 meeting with Avram. "God, I have so many meetings, it is hard to pinpoint. They break up my (singing) sessions with meetings," he said. Jackson studied Miller's questions about his ability to do two shows in one night for the millennium. Actually, the shows had been planned about 22 hours apart at the two furthest time zones of December 1999. "That would have been tough," he said, explaining "it would depend on the situation ... what happened on stage. Every show I lose 15 pounds. They weigh me before and after the show." Miller asked why he signed the contract, to do both shows. "I felt there could be a way ... it was possible," Jackson said. Jackson admitted it was easier to do three shows in one day, "like vaudeville," when he was 8 years old. He then smiled, looking out in the audience where a small boy, watching his hero, could be heard humming.

Most Downloaded Image- Santa Maria Times, Karen White Images of superstar entertainer Michael Jackson allegedly were the "most-downloaded picture" on media outlets' computers around the world Wednesday. He made the front page of newspapers from Santa Maria to New York and around the world as he appeared in a local courtroom to answer questions in a contract dispute with a German promoter. Santa Maria Superior Court Judge Zel Canter ruled against letting television cameras in his court, but relented to allow one single still photographer shoot. Thursday morning Canter almost backed out on that agreement, concerned that unflattering pictures of Jackson, taken in his courtroom, would show up in the tabloids of the world. They will, pointed out columnist Steve Corbett of the Santa Maria Times, because the First Amendment of the U.S. Constitution allows for "the good, the bad and the ugly." Arguing with the press, Canter questioned if forcing a celebrity to appear in a case like this, with photographers in the courtroom, force the person "to expose themselves to the scrutiny of the world." He asked if it was his duty to protect a witness' image, calling it "frankly awkward." After balancing "my duty to the litigant and the broader public right to know," Canter again allowed the cameras to the court's far corners. The Los Angeles Times had the "quietest" camera, so took the first day's pictures in the courtroom that showed Jackson pale and tight faced, with ruby lips that might have been colored by lipstick. A thick mop of black hair covered part of his face, with a stubble of black whiskers here and there. He wore a red shirt. The Santa Maria Times was allowed to shoot the hoopla outside the courtroom and supplied photos to the pool of media. On Thursday, the shirt was again red. The nose bandage worn Wednesday had been removed. The Santa Maria Times and People magazine shot pictures inside Thursday. The press of the world followed Jackson from Neverland Ranch near Los Olivos, his official home, to the Santa Maria Superior Court. Reporters drew for tickets to be inside the courtroom, filling most of the 24 seats. Others gathered outside with massive television transmission trucks. Adding to the event have been a crowd of up to 450 people outside each evening, cheering for the singer, especially when the cameras turn their way.

Michael Jackson kept his fans and adversaries waiting Thursday, showing up four hours late to testify for a second day in a $21 million lawsuit against him. AP Photo After a judge granted him permission to postpone his scheduled testimony until the afternoon, the reclusive pop star arrived at the courthouse without the surgical mask he had worn a day earlier, but carrying a black umbrella. Sporting a blue corduroy suit and bright red shirt, Jackson's arrival sparked cheers from about 200 waiting fans.

The singer took several minutes to sign autographs, throwing kisses as he moved past the barricaded crowd and flashing the thumbs-up sign when he went inside. Jackson is being sued for $21 million by his longtime promoter, Marcel Avram, for allegedly backing out of two millennium concerts scheduled for New Year's Eve 1999. Jackson maintains that it was Avram, not he, who canceled the shows over concerns they would not be profitable.

During his testimony Thursday, Jackson exhibited a showman's flair under questioning from Avram's Los Angeles attorney, Louis R. "Skip" Miller. At one point, Miller questioned Jackson's contention that he had worked toward the concerts by practicing dance moves and making plans to include magic in the act. "Magic?," Miller said. "Yes, magic, as in abracadabra," Jackson answered, drawing appreciative laughs from spectators. Jackson's lawyers offered no explanation for why their client needed to postpone his appearance at the last minute when jurors already had been assembled. His representatives did not return calls Thursday.

Who succeeds in a multi-million dollar civil dispute in a Santa Maria Superior Court is undecided, but superstar entertainer Michael Jackson won the hearts of many Santa Marians Wednesday. All it took were waves and autographs for the crowds waiting outside. Even his attorney, Steve Cochran, helped hand out autographs for the fans in the local "public relations effort." Jackson, 44, will be back today to answer questions concerning allegations he failed to perform in two millennium concerts. The concert promoter, Marcel Avram of Germany, is seeking more than $20 million in compensation for his costs.

The trial will continue for three weeks, but Jackson allegedly must complete his testimony by Friday because of conflicts. Avram claims Jackson canceled their contract. Jackson said Avram called him to postpone the concerts in Australia and Hawaii. Avram had promised Jackson a $15 million payday for the two concerts. The press from around the world is covering the event, coming to Santa Maria while not quite sure just where the town is located. "How many miles is it from Los Angeles?" asked one press member. At least one news outlet Wednesday morning reported the trial was in Santa Monica. Another located Santa Maria near Bakersfield. Jackson only had to come from his official home, Neverland Ranch in Los Olivos. In the court Jackson showed reserve and good manners, with "thank yous" and "you're welcomes." Louis "Skip" Miller, representing Avram, questioned Jackson for about three hours. Often the responses were "I don't understand the question," "I don't want to guess" or "I can't recall." Taking off the trademark surgical mask just before entering the courtroom, Jackson raised his right hand, promising "yes, to be truthful, of course." He then sat down, and almost by instinct, adjusted the microphone at the witness stand.

Jackson's answers were often of the "yes" and "no" variety until Miller asked about concerts. A brightened Jackson, sipping a Mountain Dew, explained that "oh, gosh" behind the scenes at the show were "gee, maybe 35 people." He talked of how he puts together a show with a band, backup singers, costumes, pyrotechnics and even magic. "Magic?" questioned Miller. "Yes, magic as in abracadabra," Jackson answered.

A group of about 24 fans got the coveted tickets to sit as spectators in the trial. For Ian Lizalde, Wednesday might be the most important day of his life. He's 24 and said, "I've been a fan since I was 7 years old," clapping hands with black-painted nails together. "I've got his records." Lizalde received one of the coveted spectator tickets, sitting in the front row. Then, cheering as Jackson prepared to leave when court ended for the day, he also received an autograph. Behind him came chants of "We love you, Michael." Lizalde knows Jackson is innocent, he added, although admitting he didn't understand much about the court questioning. Ophelia Galvan, and her two teenage daughters, Regina and Desarey, started out at 5:30 a.m. Wednesday. While their mother went to work, the two girls stayed all day at the court complex, sharing a ticket. They missed school. Desarey showed her spectator ticket, signed by the artist. Both girls and their mother all got autographs after the court session, about 5 p.m. Overwhelmed by the sight of Jackson, they said they spent their time watching their hero, not listening to the court debate.
