SANTA MARIA, Calif. — Attorneys in Michael Jackson's child molestation trial rested Friday after jurors watched what may have been the most compelling evidence against the singer in his 62-day-long trial — a tape of his teenage accuser's very first police interview, in which he reluctantly describes sexual abuse he allegedly suffered at Jackson's hands.

With a heavy sigh and a voice barely above a murmur, the eighth-grader revealed to detectives for the first time the moment his former idol allegedly crossed the line from father figure to sexual predator in spring 2003 at Neverland Ranch.

"He started to tell me how boys have to masturbate, because if we don't we go crazy," the boy said on the July 6, 2003, taped interview. Jurors appeared riveted, but did not appear to be taking many notes.

"He said that he wanted to show me how to masturbate and I said no, and he said he'd do it for me," the boy continued, his eyes cast down as detectives coaxed him to continue, to "get it off your chest."

The teen put his hand to his forehead, and touched his face. He sniffled, but did not appear to be weeping.

"He put his hand in my pants and he started masturbating me," the teen continued, adding that Jackson put his hand down his pajama bottoms and told him, "I want to teach you," and "There's nothing wrong with it, it's natural."

"I told him I didn't want to do it, but he kept on doing it," he told detectives.

The boy said that he and Jackson were lying together in Jackson's bed, where they had shared many innocent nights together watching movies, playing video games and talking until one night in February 2003 when Jackson's motives allegedly turned prurient.

After that first incident, the teen said, Jackson continued to masturbate him five times or less, "every night my brother wasn't there," he said.

The boy's younger brother, the accuser explained, had stopped sleeping with them in Jackson's bedroom because he was unwelcome.

Prosecutors say Jackson groomed the child for the lewd acts by giving him alcohol and showing him pornography.

The boy told detectives in the interview that on the first night he stayed at Neverland with the singer, they looked at "naked ladies" with Jackson's aide, Frank Tyson, on a laptop. He also described a black suitcase filled with magazines such as Hustler and Playboy, but no child pornography. Prosecutors found numerous pornographic magazines at Neverland during a Nov. 18, 2003, search.

The boy, a cancer survivor with one kidney, said that Jackson gave him wine, vodka or Bacardi every day he stayed at the mansion.

Over the course of an hour, the child's demeanor appeared to subtly shift from fidgety to withdrawn to slightly relieved and forthcoming.

Dressed in long denim shorts, a button-down shirt and tennis shoes, he sat on a couch in a small interview room containing flowers, magazines and tissues.

His interviewers, Sgt. Steve Robel and Det. Paul Zellis, began by asking him about school and sports and if he knew the difference between right and wrong.

The teen's answers appeared to come naturally, and they were consistent with his testimony in court two months ago.

Jackson sat motionless and still in the dimly lit courtroom as the tape was projected onto a screen. It was the final piece of evidence presented to jurors, marking a dramatic end to the prosecution's rebuttal case against the King of Pop.

The defense threatened this week to recall the accuser and his mother to the stand for surrebuttal, but ultimately rested their case without putting on a surrebuttal or calling the defendant to testify in his own defense.

Jackson is charged with 10 counts, including sexual molestation, giving the child alcohol, and conspiring to falsely imprison the boy and his family at Neverland in February and March 2003. He faces up to 20 years if convicted.

Jackson maintains his innocence and claims that he is the victim of a litigious family whom he naively allowed into his home and showered with gifts because he was touched by the boy's struggle with cancer.

Jurors will have Monday off for the holiday and Tuesday off while attorneys argue jury instructions in court. Closing arguments may begin as early as Wednesday

Jackson appeared somber as he left the courtroom. As he walked past the cameras, he gave a praying gesture with his hands, plucked the umbrella from his assistant's hands and carried it for himself as he headed to the waiting black SUV.

Melville ha detto che pensa di includere un'indicazione/istruzione sul capo d'accusa di reato di somministrazione di alcool a minore, SEPARATO dalle accuse di somministrazione di alcool con scopo di molestia.
Questa direttiva, che si applica a 4 dei 10 capi d'accusa contro Jackson, rende possibile la condanna di Jackson SOLO sull'accusa di somministrazione alcool SENZA che venga trovato colpevole di molestia .

Se quest' ultima ipotesi prima non era possibile, dovrebbe essere un punto a nostro favore credo.Mah...

Parties in the Michael Jackson case this morning discussed the instructions that Superior Court Rodney Melville will give to jurors before they begin deliberations.

Melville said he plans to include an instruction about a lesser misdemeanor charge of furnishing alcohol to a minor, separate from charges that Jackson gave his accuser alcohol for the purpose of molesting him.


This instruction, which applies to four of the 10 charges against Jackson, makes it possible that Jackson could be convicted on an alcohol charge without being found guilty of molestation.

Neither Jackson nor the jury were present during this morning's procedural hearing.

è anch evero che però così, se condannato per il reato di somministrazione di bevanda alcolica senza secondi fini la pena è mille volte meno forte di quella con fini di molestie

da dei ragazzi che hanno fatto ricerche sulle pene possibili per il reato di somministrazione di bevanda alcolica a minori, sembra che in california per il reato di somministrazione di bevanda alcolica a minori si rischia un minimo di 24 ore in servizi sociali e una multa sino a 1000 dollari

RIPETO: sembra, nulla di certo

inoltre mj è accusato di 4 reati distindi di somministrazione di bvanda alcolica (da stabilire se ai fini di... o meno)

LAPD/ABC Target Adults Furnishing Alcohol to Minors

The Los Angeles Police Department, assisted by the California Department of Alcoholic Beverage Control (ABC), will be targeting adults during the month of June who furnish alcoholic beverages to people under 21 years of age. The two agencies will be conducting "Shoulder Tap" operations in which a minor decoy, under the direct supervision of police officer, will attempt to get adults to purchase him/her alcoholic beverages.

ABC Director Jay Stroh said, "These operations are designed to reduce the number of deaths and injuries due to teen drunk driving. Furnishing alcohol to a minor is a serious offense."

The State Legislature passed a law in 1998 which increased the penalty for furnishing liquor to underage persons. An adult who furnishes alcohol to a minor faces a $1,000 fine and a minimum 24 hours of community service.

A law that became effective in January of 1999 says any adult who furnishes alcohol to a minor, who then injures or kills him or herself, or any others, results in the furnisher facing a minimum six months in the county jail, by a fine of up to $1,000, or both imprisonment and a fine.

The LAPD is timing the decoy "Shoulder Tap" operations with the upcoming high school graduations. It is anticipated the number of underage individuals attempting to solicit alcoholic beverages from adults will increase.

Recent "Shoulder Tap" operations conducted in the Wilshire and West Valley Areas indicate that between 50 and 60 percent of adults approached outside local liquor and convenience stores will accommodate an under-aged individual's request for an alcoholic beverage. To combat this trend and disseminate a message that the Los Angeles Police Department will actively prosecute any adult who furnishes a minor with an alcoholic beverage, two Bureau-wide "Shoulder Tap Operations" have been scheduled.

Ma guarda un po' te..e pensare che tutti gli amici di Sneddon e co. giornalisti dicevano che se non veniva condannato per molestie, veniva decisamente condannato per somministrazione d'alcol, che è un reato molto grave in california...ed ecco qui la conferma di quanto sporco ci sia di mezzo.... Siccome il giudice deve far condannare MJ di qualcosa decide di cambiare ciò che gli fa comodo....

SANTA MARIA. Calif. (Reuters) - The judge in the Michael Jackson child molestation case on Tuesday reduced one of the charges against the singer from a serious crime to a misdemeanor, a move that could help the prosecution.

Superior Court Judge Rodney Melville told attorneys in the case he would reduce the charge of supplying alcohol to a minor with intent to sexually abuse him, a felony, to the lesser charge of simply supplying alcohol to a minor.

The judge acted at the request of the prosecution and over the objections of Jackson's defense team. The main charge of molesting the then 13-year-old cancer patient remained unchanged, as did the other charges of conspiring to commit child abduction, false imprisonment and extortion.

Jackson has pleaded not guilty to all the charges.

Court observers said the move gave prosecutors an advantage as the misdemeanor charge might be easier to prove.

Jackson would have faced 2 to 4 years in state prison if convicted of the felony alcohol charge, while the misdemeanor charge carries a fine and the possibility of a shorter spell in county jail.

The accuser, both on the witness stand and in a videotaped police interview, said Jackson often gave him alcohol while he was staying with his family at the singer's Neverland Valley Ranch in central California in early 2003.

He also testified that Jackson masturbated him on several occasions after plying him with alcohol.

The judge made his decision on Tuesday while discussing with prosecution and defense attorneys how he would instruct the jury before handing them the case, and what boundaries he would set for closing arguments.

"They're arguing about the ground rules that will control everything that will happen from now on -- arguments, deliberations and verdict," said Jim Hammer, a former San Francisco prosecutor who is following the case as a television analyst.

Melville also said he would supply each juror with a set of written instructions before he addressed the panel and would allow jurors to consult them during deliberations. While not unprecedented, it is unusual for a judge in California to provide jurors with written instructions.

The prosecution and defense both ended the evidence phase of their cases on Friday and closing arguments were expected to begin on Wednesday with the possibility that the jury could be handed the case by the end of the week.

Two key players in the case, lead defense attorney Tom Mesereau and prosecutor Ron Zonen, were absent from the court room on Tuesday, presumably working on their closing arguments.

With jurors taking the day off while attorneys discussed what instructions the panel would receive from the judge, Jackson was also absent.

Non si parla + quindi di alcool servito a minori con l'obiettivo di abusarne, ma alcool servito a minori e basta.
La pena per il primo caso (alcool per abusi) è da 2 a 4 anni di carcere, per il secondo invece prevede una multa e un tempo minore di carcere.

Però, visto che questa richiesta l'ha fatta l'accusa e sapendo quest'ultima forse che le accuse sull'alcol sono state smontate...così impedisce a Mike, qualora fosse stato assolto dalle accuse di alcol, di venire automaticamente assolto di molestie!

Considerando poi che l'ultima mossa dell'accusa è il video, è come se i procuratori si stessero concentrando solo sulle accuse di molestie, che sono le più gravi!

Da questo punto di vista è peggiore la situazione!

Certo se ci preoccupavamo delle accuse di alcol allora è meglio così... infatti mettiamo l'ipotesi che Michael sia condannato per somministrazione alcool a minore...PRIMA...sarebbe stato condannato anche per molestia,...ORA...no.

come si fa praticamente in ogni causa penale verrà detto alla giuria di non tenere minimamente in considerazione il fatto che mj non abbia testimoniato, dato che è la norma

inoltre sembra verrà data ai giurati anche l'onere/dovere di decidere se i fatti del 93 siano veri o falsi per poi quindi usarli a favore o contro le attuali accuse

beh belle notizie...se poi consideriamo che l'accusa diceva anche che Michael ha ubriacato e poi molestato...eh eh eh....
