Ora gli esperti legali che stanno seguendo il processo dicono che il caso contro Jackson potrebbe cadere se la Sig. Arvizo alla fine aiutasse più la difesa che l'accusa.

SANTA MARIA, Calif. - La madre dell'accusatore di Michael Jackson si è presentata al banco dei testimoni senza che fosse presente la giuria e immediatamente, com'è suo diritto, si è appellata al 5° emendamento per non testimoniare sui pagamenti ricevuti dall'assicurazione.

SANTA MARIA, Calif. — The mother of Michael Jackson's (search) accuser took the stand outside the jury's presence Wednesday and immediately invoked her Fifth Amendment right to not testify about welfare payments she has received.

Defense attorneys have raised questions about the woman's credibility, accusing her of bilking celebrities and committing welfare fraud.

District Attorney Thomas Sneddon (search) said in opening statements that the woman would admit she took welfare payments to which she was not entitled.

Judge Rodney S. Melville (search) told jurors before the mother took the stand that the woman would testify, but that he would first hold a hearing out of their presence. The mother was then sworn in and told Senior Deputy District Attorney Ron Zonen that she would invoke her right to protect herself from self-incrimination.

Wednesday's hearing ended weeks of speculation about when prosecutors would call the woman to testify -- and whether she would testify at all. Defense attorneys have tried to turn the focus of the case from Jackson to the boy's mother, alleging that she orchestrated a scheme to have her son falsely accuse Jackson of molestation in order to get money from the singer.

Defense attorneys contend the woman should not be allowed to take the stand at all if she refuses to testify about the welfare payments. But the fact that the judge told jurors the woman would be next to take the stand -- and identified her by name -- suggests he has already decided to allow her testimony, said legal analyst Anne Bremner, a former prosecutor who is watching the trial.

The alleged welfare fraud occurred in Los Angeles County, where the mother lived. Testifying that she took payments she wasn't entitled to could open the possibility of a criminal investigation.

But charges would not be filed until welfare officials completed an investigation, said Sandi Gibbons, a spokeswoman for the Los Angeles County district attorney's office.

Santa Barbara County prosecutors could ask their Los Angeles counterparts to grant her immunity from prosecution in exchange for her testimony in the Jackson case, Bremner said.

During a break before the mother began testimony before the jury, Jackson fans outside the courthouse yelled her name and called her a liar. Senior Deputy District Attorney Ron Zonen began questioning of the woman by asking about the family's early contact with Jackson.

She described how they met the singer while her son was battling cancer, and how Jackson repeatedly invited them to his Neverland Ranch estate. She said after two visits there in 2000 and many phone calls between Jackson and her son, she began to feel "uneasy" about their contact and tried to limit it.

She said she allowed her children to return to Neverland in 2002 because they were invited by comedian Chris Tucker (search), who had also befriended the family and who she trusted deeply.

The mother became tearful when Zonen asked her about her past residences. She said she had lived from 1998 to 2003 in a small bachelor-style apartment with only one main room. She said her son and husband sometimes stayed at her mother's house because the boy had a special sterile room there.

Defense attorneys contend the family kept the bachelor apartment to make celebrities believe they were poor, but actually spent much of their time at the home of the boy's grandmother.

The mother's testimony came after the judge heard arguments from attorneys about whether she should be allowed to testify despite invoking the Fifth Amendment on the welfare issue. Defense attorney Robert Sanger argued it would be unfair to Jackson.

"You can't allow a witness to pick and choose what he or she is going to be subject to on cross-examination," he said.

Sanger said it would be unfair to allow jurors to hear the woman's testimony when it could be days or even months until the defense has the chance to cast doubt on it through testimony of other witnesses.

He said that because of the prosecutor's opening statement, the defense had focused much of its case on the payments, and it would be "extremely prejudicial" to allow prosecutors to back off from it.

The judge refused Sanger's request that he declare a mistrial and said the defense could raise questions about the mother's credibility through other testimony.

"You wouldn't be precluded from proving those items through other witnesses," Melville said.

Before jurors were called back into the court, the accuser's mother said in response to the judge's questions that she received welfare from October 2001 to March 2003. The dates overlap the period when she was visiting Jackson at Neverland and living part-time with her then boyfriend, who she later married.

The judge asked Zonen if the district attorney's office had considered giving the witness immunity from prosecution.

"We have," Zonen said. "We're not terribly interested in giving this witness immunity." He did not explain.

The mother of Michael Jackson's teen accuser sobbed on Wednesday as she told how she had watched silently as the singer licked the head of her sleeping son "over and over" during a private plane flight.

"Please don't judge me, please don't judge me," she pleaded, turning to face the jury as she recalled the incident on a late night flight from Miami to Jackson's Neverland Valley Ranch in February 2003.

She said the other passengers were asleep when she got up and looked around the plane to where her 13 year-old son was sitting next to the entertainer.

"That's when I saw Michael licking (his) head. I thought it was me, I thought I was seeing things. I thought it was me," she said, breaking into tears. She told no-one at the time what she had seen.

praticamente una scena pietosa.... se non ho capito male la mamma Arvizo ha detto che ha visto Michael leccare la testa di suo figlio durante il volo aereo,tutti dormivano.... le ha visto la scena e pensava che fosse lei,che avesse le allucinazioni? ho capito bene?

scusate ragazzi, spiegatemi una cosa......ma leccare in testa in che senso??? sui capelli (che schifo, ma come si fa)..............in fronte, sul viso....non l'ho mai capito bene stò concetto di leccare in testa.........è assurdo.......
