Judge OKs Explicit Material in Jacko Trial

SANTA MARIA, Calif. — Books, magazines and adult material described as sexually explicit will be admitted into evidence at Michael Jackson's (search) child-molestation trial, the judge ruled Friday in California Superior Court in Santa Maria.

However, these materials cannot be described — for instance, by prosecutors — as pornographic, obscene or erotic.

Judge Rodney Melville (search) also ruled that the Martin Bashir (search) documentary "Living With Michael Jackson" — as seen in Europe, not the one Bashir did for ABC — is also admissible and may be shown at trial.

Melville urged lawyers to play nice in the courtroom.

"The world is watching justice in the United States. I won't put up with any name-calling in the trial," he told prosecutors and attorneys for Jackson.

The pretrial hearing Friday was also meant to determine whether Jackson's young accuser should testify in open court. Prosecutors want to close the courtroom to the media and public when the boy, now 15, and his 14-year-old brother testify. Reporters would be allowed to hear their voices through an audio feed.

The Bashir documentary aired on the ABC television network in 2003. In it, Jackson defends his practice of sleeping in the same bed with children.

Defense lawyers have objected to the screening, denouncing the documentary as "heavily edited in the most sensational fashion possible."

Prosecutors have subpoenaed Bashir to testify about the making of the documentary. Bashir is fighting the subpoena, arguing that under both California law and the U.S. Constitution, he cannot be forced to testify.

A Jackson family attorney, Debra Opri, told "FOX and Friends" Friday morning that she did not think jurors should see Bashir's movie.

"[Santa Barbara County District Attorney] Tom Sneddon is known as 'Mad Dog' Sneddon, and he got his sights on Michael, and this documentary just gave him the fodder," Opri said.

"This documentary was so inflammatory to Michael, and while I don't think Martin Bashir should be taking the stand, he will be used by the prosecution to attempt to lay a foundation to get that documentary in," she continued. "And that documentary is sensationalist — it was edited with an angle of showing Michael as different, a freak."

Jackson, 46, has pleaded not guilty to the charges of molesting a 13-year-old boy and plying him with alcohol.

Jury selection in the case begins Monday, and could last six to eight weeks. The judge and attorneys for both sides are expected to screen as many as 750 prospective jurors.

Opri told FOX that Jackson's parents were eager to get the trial started.

"Right now, it's like 'Let's get this under way,'" she said. "They believe their son is innocent, and they think the evidence will come out to show that. Everybody is nervous. When you start a criminal trial, everybody is nervous."

Comunque questo materiale non potrà essere descritto, per esempio dall'accusa, come pornografico, osceno o erotico.
Il giudice Melville ha anche deliberato che venga ammesso come prova il documentario di Martin Bashir LWMJ così come editato in Europa - e non negli USA - e che potrà anche essere mostrato al processo.

Melville si è raccomandato con gli avvocati di comportarsi bene in aula.
"Il mondo sta osservando la giustizia negliStati Uniti. Non ammetterò nessun epiteto nel processo" ha detto all'accusa e alla difesa.
L'udienza preliminare di venerdì doveva anche discutere se la testimonianza del giovane accusatore in aula debba essere pubblica. L'accusa vuole chiudere fuori i media e il pubblico quando i due ragazzi di 15 e 14 anni testimonieranno. I giornalisti potrebbero sentire soltanto le voci tramite un collegamento audio.

La difesa si era opposta al mostrare il documentario in aula denunciando che è stato "montato apposta nel modo più sensazionalistico possibile". L'accusa ha chiamato a testimoniare Bashir sul documentario ma lui si è opposto dicendo che per legge non può essere obbligato a testimoniare.

Un avvocato vicino alla famiglia Jackson ha detto al programma "FOX and Friends" venerdì mattina che i giurati non dovrebbero vedere il documentario di Bashir."Tom Sneddon è conosciuto come 'Cane Pazzo'Sneddon, e ha messo gli occhi su Michael e uesto documentario gli ha semplicemente fornito il pretesto. Questo documentario è stato così cruciale per Michael e anche se non credo Bashir verrà a testimoniare, verrà usato dall'accusa per cercare di farlo ammettere come prova; e quel documentario è sensazionalistico - è stato montato in modo da far apparire Michael come uno diverso, un mostro."

L'avvocato ha anche detto a Fox news che i genitori di Jackson non vedono l'ora che inizi il processo. "Credono che loro figlio sia innocente e pensano che saranno presentate le prove che lo accerteranno. Sono tutti ansiosi. Quando inizia un processo penale, sono tutti nervosi."

intendo dire che su ogni mozione presentata dall'accusa e contestata dalla difesa il giudice ha sempre deliberato per l'accusa, non ha mai accolto le opposizioni. Ti sembra un buon segno? A me no, poi si vedrà......

il documentario dovrebbe essere mostrato proprio per far vedere quanto bene e' stato montato....e poi anche se Michael nel documentario di Bashir appare come un mostro ke c ce ne frega..L'IMPORTANTE NON E'APPARIRE MA ESSERE...
