SANTA MARIA, Calif. — Michael Jackson's (search) lawyers are expected to focus on inconsistent statements by the singer's accuser at his child molestation trial on Wednesday.

The defense is using its cross-examination of Sgt. Steve Robel (search) to let the jury hear about the changing stories the accuser and his brother and sister told investigators.

Among key inconsistencies are those involving the accuser's versions of when the alleged molestations took place. He initially told detectives he was molested "about five times." That changed when investigators established Jackson wasn't always at his ranch during those times.

Pressed by Jackson's lawyer, the boy indicated he was molested twice and said both times were after he had defended Jackson on a videotape and to social workers. The defense is suggesting Jackson would never have molested the boy at the very time the singer's conduct was under examination.

Robel, the lead investigator in the case, said he urged the accuser and his family to go forward with his claims against Jackson by promising them, "We're going to try our best to make this case work."

Defense attorney Robert Sanger (search) confronted Robel on Tuesday with those and other statements from recorded interviews, suggesting they indicated investigators were biased against Jackson from the beginning.

He quoted Robel as saying, "One thing I want to emphasize is you guys are doing the right thing here. ... I don't care how much money they have. He's the one who's done wrong. ... We're going to try to bring him to justice."

Sanger asked: "That's not the statement of someone with an open mind who's trying to find the truth, is it?"

Robel said that during his training he was taught to make such a statement to alleged victims.

"That statement is to reassure them," he said, "because they were terrified when they came forward. It took us two weeks to get them to come in."

Sanger asked: "Isn't the technique you are taught to tell them (is) to be honest and not to tell them they're right, everyone else is wrong?"

The witness, due back on the stand Wednesday, answered that was not the technique he was taught.

Robel's testimony came after the singer's accuser wrapped up his testimony by saying he told a school administrator that Jackson had not molested him because he wanted to avoid teasing from classmates.

Defense attorney Thomas Mesereau Jr. revealed Monday in the cross-examination of the boy, now 15, that he had once denied being molested in a talk with Jeffrey Alpert, a dean at John Burroughs Middle School in Los Angeles.

The boy testified Tuesday that he got in fights with other students when he returned from Jackson's Neverland Ranch in March 2003 because they would mock him.

"All the kids would laugh at me and try to push me around and say, 'That's the kid that got raped by Michael Jackson,'" said the boy, who alleges Jackson molested him at least twice at Neverland.

He said fighting got him summoned to the office of a school dean, and that was when "I told him that it didn't happen."

"Why did you tell him that?" District Attorney Tom Sneddon asked.

"All the kids were already making fun of me in school and I didn't want them to think it happened," the boy said.

The conversation was prompted by the Feb. 6, 2003, TV documentary that showed Jackson with the boy and in which Jackson acknowledged sharing his bed with children, although he characterized it as innocent and non-sexual.

Mesereau concluded his questioning of the boy Tuesday by asking if he realized he could profit by filing a lawsuit against Jackson before he turns 18. The boy said he did not know that.

Prosecutors claim Jackson conspired to hold the boy, his mother, sister and brother captive to get them to record a video rebutting the TV documentary. The family heaped praise on Jackson in the rebuttal video.

Sneddon's redirect questioning was relatively brief. He had the boy talk again about his bout with cancer, how he had become close to God and what he thinks of Jackson now.

"I don't really like him anymore," the boy said. "I don't really think he's deserving of the respect I was giving him as the coolest guy in the world."

Later, Sanger elicited several inconsistencies in the accuser's statements — including the number of alleged molestations. The boy initially alleged Jackson had masturbated him five times.

"Your investigation disclosed on the (the family's) last days at Neverland there were not five occasions when the molestation could have occurred," Sanger asserted.

"No, that's not correct," said Robel, conceding there were "two or three days" when Jackson was not present. He also acknowledged that in the boy's first interview, he gave different versions of when he was first molested.

La cnn riporta che il caso contro MJ è sempre aperto e che ci sono altre persone che si stanno facendo avanti, e che stavano già facendo ricerche su di lui e avevano un mandato d'arresto prima di novembre 2003.....

"We're currently continuing to investigate this case," Santa Barbara County deputy sheriff Sgt. Steve Robel said during testimony in Jackson's trial. "We're also having other people come forward."

Robel did not provide details. His comments came in response to a suggestion by defense attorney Robert Sanger that investigators prematurely searched Jackson's Neverland Ranch when they should have first gathered more information.

Robel also said authorities had obtained a search warrant and an arrest warrant for Jackson before investigators went to Neverland on November 18, 2003, to search the property. Jackson was arrested two days later.

Oggi la star si e' presentata vestita di blu elettrico

(Apcom) - Michael Jackson e' entrato oggi nell'aula di tribunale vestito con una giacca blu elettrico, per affrontare il dodicesimo giorno del processo a suo carico, in cui si sta difendendo dalle accuse di molestie sessuali su minore. Con la conclusione ieri delle testimonianze dei principali accusatori della pop-star - Gavin Arvizo, il minorenne che ha dichiarato di essere stato molestato, e i suoi fratelli - , il processo entra ora in una fase piu' tecnica in cui saranno chiamati a testimoniare gli esperti. Tra le persone che verranno sentite nei prossimi giorni nell'aula di Santa Maria, figura anche lo psicologo del ragazzo, il dottor Stan Katz, teste chiave per determinare la credibilita' del 15enne.

In una causa basata piu' sulla credibilita' dei testimoni che non su prove oggettive, l'ago della bilancia oscilla continuamente a favore o sfavore della star. Nei quattro giorni in cui e' stato sentito Arvizo, la difesa aveva inizialmente dovuto incassare colpi, riuscendo poi a ribaltare la situazione quando il ragazzo aveva ammesso di aver negato due volte di essere stato molestato rispondendo alla domanda precisa del preside della sua scuola. Ieri, pero', il ragazzo, 13enne al momento dei fatti, aveva riconfermato tutte le sue accuse, dichiarando di aver negato per evitare di essere emarginato dai suoi compagni.

Una notizia riportata oggi sul sito di Abc News potrebbe pero' screditare pesantemente l'accusatore. Il comico tv Jay Leno, in una registrazione in possesso della polizia di Santa Barbara, California, avrebbe testimoniato di essere stato contattato telefonicamente dal ragazzo e da sua madre. Durante la conversazione, che al comico era sembrata preparata, Leno aveva avuto l'impressione che la famiglia di Arvizo fosse in cerca di soldi. Gavin durante la sua lunga testimonianza aveva negato di aver mai parlato con Leno.

Ieri e' stato sentito anche il sergente Steve Robel, responsabile delle investigazioni che hanno portato all'incriminazione di Jackson. L'avvocato della difesa Robert Sanger ha portato all'attenzione della giuria conversazioni registrate in cui l'investigatore rassicurava la famiglia dell'accusatore dicendo cose come: "cercheremo di fare del nostro meglio per far funzionare questo caso". Sanger ha quindi insinuato che le indagini sul caso potrebbero essere state indirizzate fin dall'inizio contro la star del pop.

The jurors in the Michael Jackson trial were treated to porn show yesterday, as they were shown Jackson's collection of pornography.

This included magazines, DVDs and books that were seized Jackson's bedroom.

The police witnesses stated that the porn was found in several places; two briefcases in Jackson's bedroom, a box at the foot of his bed, a nightstand, a plastic bag, a computer case next to his bathroom sink, on the edge of his Jacuzzi-style bathtub, in a bathroom closet and on a television.

It included magazines with titles such as "Barely Legal" and "Teenage", along with "Penthouse" and erotic books by well-known photographers.

Santa Barbara County Sheriff's Deputy Karen Shepherd testified to finding a book titled "Camp Cove, Photos of Sydney Men," and another titled "Dress up: Playacts and Fantasies of Childhood."

The videotapes included one entitled "Believe It or Not," which depicted a variety of unusual sex acts.

The material is all legal, and Gavin did not remember seeing any one specific item.

One of the police witnesses, Santa Barbara County Sheriff's Sgt. Steve Robel, testified that Gavin Arvizo had told the police that he thought that the singer had molested him five to seven times; however, he could only remember the details of two occasions.

Robel said that Gavin became withdrawn, when he first told police about the alleged abuse:

"He became very, very quiet, folded his arms and sunk down in the chair. At one point in time he got a little choked up."

Nell’udienza di ieri sono stati ancora raccolti punti a favore della difesa di Michael Jackson. Dall’inizio del processo, due settimane fa, abbiamo assistito ad un continuo susseguirsi di colpi di scena scabrosi che avvalorerebbero le accuse e molti altri, forse molti di più, che andrebbero a screditare le accuse stesse e i testimoni presentati dalle accuse. A questo punto di questo processo-show la superstar Michael Jackson, con il suo team di difesa, sembra essere in vantaggio.

Ieri in tribunale l’accusa ha chiamato a testimoniare Steve Robel, lo sceriffo che ha fatto partire le indagini nei confronti di Jackson, a seguito della denuncia da parte della famiglia Arvizo e seguito del colloquio che il minore ha avuto con lo psicologo Stan Katz, nel quale Gavin raccontò per la prima volta le presunte molestie subite.

La parte interessante della testimonianza dello sceriffo è stata però il contrinterrogatorio da parte della difesa. Robert Sanger, uno degli avvocati di Jackson, si è infatti focalizzato sui cambiamenti di versione che Gavin dava delle presunte molestie mano a mano che il tempo passava. Sanger ha infatti riportato che inizialmente il ragazzo “riportò da 5 a 7 atti di molestie, ma non si scodava bene i dettagli, solo di due aveva ricordi chiari”. Ma lo sceriffo continua ammettendo che a seguito delle indagini, per cui scoprirono che Michael non era al ranch di Neverland per i giorni indicati dal ragazzo per le presunte molestie, si fece scendere le accuse di molestie da 5-7 a 2.

L’avvocato Sanger inoltre ha puntato contro il dito verso i metodi usati durante gli interrogatorio ai due minorenni, Gavin e fratello, definendoli troppo persuasivi. Robel ha dovuto infatti ammettere che il metodo usato nell’interrogatori ai ragazzi non sono furono quelli standard da adottare in casi come questo.

Ma altri colpi di scena si sono verificati in aula nella mattinata di ieri, mercoledì 16 marzo. È stato infatti mostrato alla giuria un video che ha mostrato il materiale erotico sequestrato nella perquisizione del 18 Novembre 2003 nel ranch di Neverland, di proprietà di Michael Jackson. Nel video si sono viste riviste come “Barely Legal”e “Penthouse”, che mostrano nudi di donne, assieme ad alcuni libri erotici di famosi e affermati fotografi. Questa raccolta di materiale erotico conterrebbe anche delle Videocassette e DVD. Tutto materiale legale e che non dimostrerebbe nulla ai fini del processo, al contrario di quello che l’accusa vorrebbe fare credere. Ma non solo, Mesereau ha infatti sottolineato come la maggior parte di questo materiale abbia una data di pubblicazione a marzo 2003, data nella quale la famiglia Arvizo si allontanò definitivamente, quindi come sia impossibile
che Jackson abbia mostrato questo materiale ai minori. Ma la difesa ha subito
in ulteriore colpo, non è stata infatti in nessun modo in grado di dimostrare che Gavin abbia mai visto questo materiale, infatti non è stato in grado di riconoscere nessuna delle riviste mostrate.

Jackson, come ha sottolineato Mesereau nella dichiarazione di apertura, ammetterà di possedere materiale erotico, ma di non averle mai mostrate ai minori.

Ma la credibilità dei testimoni viene sempre di più minata.
